As an attorney with vast experience representing both businesses and individuals, I bring a varied perspective to the litigation and dispute resolution process. I have seen how lawyers frequently do not take their clients' business and other non-litigation interests into account when planning a litigation approach. The lawyers may not even know their client’s larger goals or interests beyond the particular case they are handling.

 

A litigating attorney is trained to win the case or bring about the "best" settlement, but that is often only analyzed in the context of the single case being handled. This can result in less than optimal overall outcomes – even if the case is "won" in the courtroom.

In addition to a wealth of experience handling both complex and less complex cases, I have also managed litigation at several law firms.

Strategic Goals​

Companies that are regularly involved in litigation should have a clear strategy for handling such matters. It may be that a company requires more than one strategy for different types of disputes. Similarly, law firms generally need one or more litigation strategies to effectively and profitably manage their litigation.

 

For example, a retail seller might need one strategy for dealing with routine premises liability matters and different strategy for dealing with more unusual claims. If there are no overall strategic visions for handling different types of claims the processes can be both more expensive and lead to poorer outcomes.

 

Tactical Approaches

Even with a sound overall strategy for dealing with certain types of cases, unless there are sound tactical approaches, a suboptimal outcome is likely. At least one aspect of a sound tactical approach is the coordination between the company and its outside counsel.

 

If the overall strategies for handling a company’s cases are not clearly communicated to outside counsel, and if systems are not in place to be sure that the company’s cases are being handled in a manner consistent with the overall strategy and in accordance with determined tactical approaches, again, suboptimal results can be expected. In some instances the development of such tactical approaches should be a team approach with outside counsel.

For a law firm, the tactical approaches will include: what type of software to be used for managing cases; the circumstances in which additional software is to be used to organize certain cases; and determining the most efficient methods of resolving cases.

 

Individual Case Goals

There may be times, particularly in cases that are significant to a company (either in terms of dollar exposure or in ways that are not directly monetary) when an outside consultant can provide a fresh view of how a case is being handled: assuring that the company is clear on its objectives and that the law firm is efficiently and effectively moving the case toward a resolution consistent with what the company has determined to be in its best interests. In such significant cases it might be a good idea to engage an outside litigation consultant in to review the matter and possibly explore alternative dispute resolution even while litigation is ongoing. Often it is NOT a good idea to have trial counsel broach settlement or alternative dispute resolution with the opposition as it might be perceived as a sign of weakness.

 

For a law firm I can be of assistance simply as a consultant on how to handle a specific lawsuit. I regularly receive calls from other attorneys seeking advice on how to handle certain situations or the best approach to take in a particular case.

 

Speaking Engagements

I am available to speak with members of your organization on any of the topics I outlined above. This can be either a lecture or a workshop. For example, I can facilitate workshops to assist an organization in identifying its strategy/strategies or to develop ideas on tactical approaches for assuring that the company’s strategy is being followed. These are often not issues which can be solved or determined in a single day, but such workshops can assist the organizations key personnel in ways of approaching these issues that will become keys in ultimately developing such strategies or tactics.
